Terms & Conditions
These general terms and conditions of sale (hereinafter "GTC") of La Purative SARL (hereinafter "La Purative") apply to all services and products (hereinafter "Products") of La Purative's online shop. All other services are governed by separate terms and conditions.
Orders that can be placed on the Purative website are strictly reserved for private individuals.
By accepting these Terms and Conditions before confirming your order, you declare that you are in full legal capacity to commit yourself under these Terms and Conditions and that your purchase of products on the website is not directly related to a professional activity and is limited to a strictly personal use.
2. Scope of application
These conditions apply to all products or services offered by La Purative in its online shop. All sales and deliveries are made exclusively according to these conditions.
Any terms and conditions of the customer that deviate from or contract with these terms and conditions are not recognized by La Purative, unless expressly agreed in writing.
3. The services of La Purative
La Purative constantly strives to be innovative and up-to-date. We provide our services in a professional and careful manner, in accordance with these and other contractually agreed terms. The Purative constantly strives to offer its customers the best and most up-to-date
All La Purative prices, unless otherwise stated, include VAT, advanced recycling fees and copyright license fees.
Our prices are subject to change at any time without notice, however, ordered items will be charged at the price in effect at the time you place your order, subject to availability of the selected product. Before sending the order form, please check the final price indicated.
Errors in pricing may occur due to problems with the timing of feed updates and due to human error.
In the event of a price error or unavailability of the ordered product, the buyer will be alerted by the Customer Service within 72 hours of the knowledge of this event. In such a case, the Customer may choose to modify the order or to cancel it, in which case the Seller will refund the sums paid by the Customer.
5. Product information, availability and warranty
La Purative constantly strives to provide its customers with the best possible information on the products and services offered.
Some of this information is provided directly by the manufacturer or supplier of the product, which La Purative has compiled and published in a manner accessible to its customers.
La Purative does not offer any guarantee on the information it provides concerning products, services, recommendations, conditions and warranty periods. In particular, La Purative assumes no responsibility for the accuracy, completeness and timeliness of such information.
La Purative attaches great importance to monitoring the availability of its products with the greatest possible care and accuracy. Many products come from manufacturers outside Monaco. Production or supply shortages or incorrect inventory data may cause delays in delivery.
The Purative assumes no responsibility for information regarding expected delivery times, which should not be considered binding and may be changed at any time without notice. It is possible that delivery may become impossible if a product can no longer be manufactured or delivered. In this case, §6 below shall apply.
6. When do you enter into a contract with La Purative?
The products, services and prices published on www. [lapurative].com constitute an offer to sell. However, this offer is always subject to the further condition that delivery may not be possible or that the price has been incorrectly displayed (either by the manufacturer or by La Purative). This means that items that are no longer available will not be delivered. It may also mean that we have not indicated the correct price in our shop.
The customer enters into a contract with La Purative when he/she submits an order via our webshop or by e-mail. La Purative will acknowledge the customer's order by sending an automatically generated order confirmation e-mail. This automatically generated order confirmation does not guarantee that the product is actually available and can be delivered. It merely indicates to the customer that La Purative has received the order and that the customer has entered into a contract, subject to La Purative's ability to fulfill the order.
If the product is not available or if the price has been incorrectly displayed, the contract will be terminated immediately without further action by the parties. We will inform the customer immediately if this situation occurs. If the product has already been delivered to the customer, ownership of the item automatically reverts to La Purative and the customer is obliged to return it in exchange for a refund of the purchase price by La Purative. If the product has not yet been delivered to the customer, the customer will not be obliged to pay the purchase price or to accept delivery. In either of these situations, La Purative is not obliged to make a replacement delivery.
7. What are the payment terms we offer?
The customer agrees to pay using one of the payment options offered by La Purative. At this time, only compatible credit and debit cards displayed during checkout in the online shop are available. After completing the purchase, the customer will receive a receipt by e-mail and the order will be assembled by La Purative and prepared for shipment.
The products delivered to the customer remain the property of La Purative until full payment of the purchase price is received. The customer hereby grants La Purative the right to place a lien on the products for which it holds a property right.
8. What happens in case of default of payment?
If the customer fails to meet its payment obligations in whole or in part, all amounts due shall become immediately payable. La Purative reserves the right to suspend all deliveries. Furthermore, La Purative reserves the right to terminate the orders concerned. Termination of the contract shall occur automatically and without notice eight days after La Purative has sent the customer a warning demanding payment.
La Purative may charge a fee of EUR 20.00 for the manual administrative work necessary to collect unpaid claims from the second reminder. In addition, La Purative reserves the right to initiate collection proceedings with an agency determined by La Purative. Any invoice submitted to a collection agency may result in additional costs for the customer. These costs will be at least EUR 50.00.
La Purative may withdraw the customer's right to place orders against invoice at any time, in particular in the event of non-payment or other circumstances reducing the customer's creditworthiness. In this case, the customer may only place prepaid orders with a credit card.
9. Cancellation and termination of the contract
Orders placed by the customer with La Purative are binding as described in §6 above. The customer is then obliged to accept the delivery of the ordered services or products. Subsequent changes and cancellations are possible in certain cases, but only at the discretion of La Purative and may result in a processing fee of up to 30% of the contract value, but not less than CHF 50.00, as well as any loss of value of the products since their order.
If the customer does not accept delivery of the products as provided herein within two weeks, La Purative may terminate the contract and charge the customer the processing fee mentioned in the previous paragraph.
Returnable items can be sent back to La Purative within 14 days after the invoice date. Please note: the items must be absolutely new and in their original condition, including all labels and original packaging, and must be returned with the invoice. Returns can be sent by post. The cost of returning the goods is borne by the customer.

In principle, the return of products is not possible. Only in exceptional cases and after consultation with La Purative can exchanges or returns be accepted. The price basis for returns and exchanges is always at most the current price of the article on the day of the return or exchange. Products ordered especially for the customer and custom-made products are completely excluded from returns or exchanges.
11. Deliveries by La Purative
La Purative reserves the right not to fulfil, in whole or in part, an order for a country in which it has specific distribution agreements, or in which specific local regulations exist. La Purative will inform you of this.
A contribution to the costs of packaging, insurance and shipping is requested for each order and is included in the delivery costs indicated before the validation of the order by you.
The delivery address taken into account is the one indicated by you at the time of your order.
Delivery is made according to the delivery method chosen during the online ordering process. For shipments, the contribution to packaging, insurance and shipping costs depends on the weight of the order and the destination country. For online orders, this price will be indicated before the final validation of the order.
Please note that it is more interesting to group all your items in one order. Please note that if you place two (or more) separate orders for the same delivery location on the same day, we will not be able to group them together and shipping costs will be charged for each.
All orders, whether delivered to the customer's premises or collected from a collection point, must be checked immediately for accuracy, completeness and integrity. In the event of any error or damage (whether visible or not), the customer must notify La Purative immediately upon discovery, but no later than 7 calendar days after receipt of the delivery or collection of the order. In order for La Purative to process your claim for damages, the order and its packaging must be retained and the product(s) must not be used.
12. Warranty - Right of withdrawal
In case the ordered product does not suit you or is defective or does not correspond to your order, La Purative grants you a withdrawal period of 14 days following its receipt.
The withdrawal period expires 14 calendar days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the goods.
To exercise this right, you must notify us of your decision to withdraw from this contract within the 14-day period mentioned above by means of an unambiguous statement by e-mail to the following address: email@example.com
In order for the withdrawal period to be respected, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the expiry of the withdrawal period.
In case of withdrawal from the present contract, La Purative will reimburse you, without undue delay, the amount corresponding to the product which is the object of the withdrawal, including the delivery costs in case the entire order (paid products and gifts) will be returned (except for the additional costs resulting from the fact that you have chosen, (except for any additional costs arising from the fact that you have chosen a delivery method other than the cheaper standard delivery method offered by La Purative) and in any event no later than 14 (fourteen) days from the day on which we are informed of your unambiguous written decision to withdraw from this agreement. You will be responsible for the costs of returning the goods.
You must return the goods that are the subject of the withdrawal in their packaging, in perfect condition, and with all their accessories, if any, to the following address, without undue delay and, in any event, no later than 14 (fourteen) days after you have informed us of your decision to withdraw from this contract. This period is deemed to have been respected if you return the goods before the expiry of the fourteen-day period, at your expense and via an appropriate delivery method, to the following address

The right of withdrawal cannot be exercised for orders concerning products which have :
Traces of use on the product
Products without original packaging
Products that have been damaged during return shipment
Items lost in the return shipment (we recommend that you keep the receipt and tracking number of your return shipment)
La Purative will refund you using the same method of payment as for the original transaction, unless a different method is expressly agreed; in any event, this refund will not incur any costs for you.
13. Redemption of discount coupons
Purative may issue discount coupons. These coupons may require a minimum order value. This will be indicated on the coupon itself. Discount coupons cannot be combined. This means that only one coupon can be redeemed per purchase. Coupons can be redeemed both online and at some retailers. However, if the coupon states that it can only be used online, it cannot be used in the shops.
La Purative hereby waives all liability for damages resulting from non-delivery, breach of contract, negligence in entering into the contract or wrongful acts, unless they are the result of intentional or grossly negligent actions of La Purative or its agents.
WARNING: Any liability for indirect or consequential damages resulting from the use, misuse or failure of the products supplied by La Purative is excluded.

Thank you for your interest in our products. The protection of your privacy is very important to us. Below we provide you with detailed information on how we process your data.
Data collection, processing and storage
You can visit our website at any time without providing any information about yourself. We only store access data without personal reference, such as the name of your internet service provider, the site you came from or the name of the file you requested. This data is only used to improve our website and does not allow us to draw any conclusions about you. Google Analytics can be used for this purpose. You can prevent this analysis by installing special software in your browser.
Disclosure of personal data
We will pass on your data to the company that ships your order, to the extent that this is necessary to deliver the goods. To process your payment, we will share your payment data with the bank responsible for processing the payment.
Right to information
In accordance with the Federal Data Protection Act, you have the right to request information about the data we have stored about you and the right to correct, block or delete this data.
16. Applicable law
These GTC are subject to change at any time. The new general terms and conditions of sale will only apply to sales made after the modification.
All sales made via our website as well as the present General Terms and Conditions of Sale are governed by French law.
